TERMS OF SERVICE

These Terms of Service govern purchases from O’HARA DIAMONDS and the use of oharadiamonds.com. O’HARA DIAMONDS is operated by SIA Sun Two, registration number 40203243097, VAT number LV40203243097, registered address Egļu iela 19, Rīga, LV-1024, Latvia (“O’HARA”, “we”, “us”). 1. Scope and acceptance

By placing an order, you confirm that you are legally able to enter into a contract and that the information you provide is complete and accurate. These Terms apply together with the product page, order confirmation, Shipping Policy, Return and Refund Policy and Privacy Policy. Mandatory consumer rights always prevail where they provide greater protection.

2. Products and product information

We sell fine jewellery made with natural or laboratory-grown diamonds and precious metals. The applicable diamond origin, metal, carat weight, dimensions and documentation are stated on the product page or order confirmation.

Images are intended to represent the product faithfully, but colour, scale and appearance may vary slightly because of lighting, screen settings and the natural or manufacturing characteristics of stones and metals. Carat weights and measurements may be subject to customary jewellery tolerances. For earrings sold as a pair and multi-stone jewellery, stated carat weight may be the total weight of all stones unless the product page states otherwise.

Not every stone in multi-stone jewellery is individually certified. Any included grading report or certificate will be identified on the product page or order confirmation.

3. Prices and payment

Prices are shown in the currency selected for the market and include applicable VAT where required. Delivery is complimentary to destinations available at checkout unless an optional premium service is expressly selected. Any import duties or local charges for destinations outside the European Union, where offered, are the customer’s responsibility unless stated otherwise.

Payment must be authorised before an order is accepted. We may use payment and identity-verification measures proportionate to the value and risk of the order.

4. Orders and contract formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not itself constitute acceptance. A contract is formed when we send an order acceptance or confirm that the order has entered processing or production.

We may decline or cancel an order before acceptance where a product or material is unavailable, payment or delivery verification cannot be completed, fraud is suspected, delivery cannot be completed safely, or a clear pricing or product-information error has occurred. Any amount collected for an order we do not accept will be refunded.

5. Ready-to-ship, made-to-order and personalised products

A product may be identified as Ready to Ship, Made to Order, Bespoke or Personalised. Estimated preparation time and the selected specifications form part of the order.

Made-to-order jewellery is produced after acceptance. Selecting a standard option does not by itself remove a consumer’s statutory withdrawal rights. The statutory withdrawal right may be excluded only where the product is genuinely made to the customer’s individual specifications or clearly personalised, as permitted by applicable law. This does not affect rights relating to faulty, damaged or non-conforming goods.

Changes or cancellation requests should be sent immediately to hello@oharadiamonds.com. Once production of a genuinely bespoke or personalised item has started, cancellation may no longer be possible.

6. Delivery

Delivery is governed by our Shipping Policy. We provide complimentary standard delivery to destinations available at checkout. The delivery estimate shown for the selected item on its product page and at checkout is the estimated total time to receive the item, including preparation or production and transport. Where stated for an item, 4–5 weeks for Made to Order or 5 business days for Ready to Ship is the total estimated delivery time. Delivery dates are estimates unless we expressly agree otherwise.

High-value deliveries may require a signature, identity verification, delivery to the verified address or collection from a secure carrier location. Risk passes to a consumer when the product is physically received by the consumer or a nominated third party other than the carrier.

7. Withdrawal, returns and refunds

Eligible EU consumers generally have 14 calendar days after receipt to withdraw from an online purchase without giving a reason. Exceptions permitted by law, including for genuinely personalised or made-to-specification products, may apply. Full instructions, conditions, return costs and the model withdrawal notice are set out in our Return and Refund Policy.

Please contact hello@oharadiamonds.com before shipping high-value jewellery so that we can provide secure packing and return instructions. Prior contact or return authorisation is not a condition for exercising a valid statutory right of withdrawal. Do not use the address on the original shipping label unless it is also the return address stated in our Return and Refund Policy or we have confirmed it as an appropriate return address.

8. Faulty or non-conforming goods

Nothing in these Terms limits the statutory legal guarantee or remedies for faulty, damaged, incorrect or non-conforming goods. EU consumers are entitled to the minimum legal conformity protection required by applicable law, which may include repair, replacement, price reduction or refund. Please contact hello@oharadiamonds.com and retain the product, packaging, delivery label and accompanying documentation.

Normal wear, accidental damage, loss, impact damage, inappropriate cleaning, unauthorised repair or damage caused by failure to follow reasonable care instructions is not a manufacturing defect.

9. Certificates, security and authenticity

A grading report or certificate supplied with a product forms part of that product. Security tags, serial or report numbers, weights, measurements and product condition may be documented before dispatch and verified on return. This does not restrict lawful inspection or mandatory consumer rights, but the customer may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and fit of the product.

10. Website use and intellectual property

All website content, branding, photographs, text, graphics and design are owned by or licensed to O’HARA and may not be copied, reproduced or used commercially without prior written permission. You must not misuse the website, interfere with its operation or attempt unauthorised access.

11. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights. To the extent permitted by law, we are not responsible for indirect business losses or events outside our reasonable control.

12. Privacy

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law. Payment information is processed by the relevant payment provider.

13. Governing law and disputes

These Terms are governed by Latvian law. If you are a consumer resident in another country, this choice does not deprive you of mandatory protections available under the law of your habitual residence. Consumers may also use the competent consumer-protection and dispute-resolution bodies available in their country.

14. Changes and severability

We may update these Terms for future orders. The version in force when the order is accepted applies to that order. If any provision is found unenforceable, the remaining provisions remain effective.
